Voters could lose right to elect Utah AG

SALT LAKE CITY (ABC 4) - Talk of impeaching Utah Attorney General John Swallow is swirling around Capitol Hill as he faces allegations of breaking campaign laws.

SALT LAKE CITY (ABC 4) - Talk of impeaching Utah Attorney General John Swallow is swirling around Capitol Hill as he faces allegations of breaking campaign laws.

On May 15 a group of lawmakers used the backdrop to try and change the way Utah's Attorney General is elected.

A committee meeting was on May 15 to discuss this possibility.

Utah voters choose Utah's attorney general, but Sen. Lyle Hillyard R-Logan says the Governor would choose a better attorney general.

ABC 4 Utah's Noah Bond said to him, "Some people would say hey you're taking the power away from us and giving it to the Governor.  We don't want that.  That's what some people would say. What do you want to say to that person?"

Sen. Hillyard responded, "I would say to them, do you really know who the Attorney General is? How much do you know about the Attorney General?"

Bond replied, "So you're saying because the public is uneducated, the Governor should have the power?"

Sen. Hillyard, "They're really not aware of who they're electing, what the background is."

Both the governor and the attorney general serve on the executive branch.  "My opinion is he should have someone in the Attorney General's roll who works with him. They have the same political agenda," Hillyard said.

However, most lawmakers who talked with Bond on Capitol Hill say they want Utah voters to choose the attorney general.

Lawmakers would have to amend Utah's State Constitution to give the governor power to appoint an attorney general.  The debate could begin during the 2014 legislative session.
