A probable cause statement first made public this week states, "On April 12, 2012 in Summit County, the defendant, while caring for a 4 year old male child, was frustrated and choked the child with enough force to leave marks and scratches."
It continues, "The defendant also twisted the child's arm, also causing injury...the defendant choked the crying 4 year old in front of a 6 year old witness."
ABC 4 took the serious allegations to the people Corey was sworn to protect.
"It sickens me that something like this would occur especially up here in Summit County. We'd like to think that this is a slice of heaven," said Kyle Wagstaff.
The court proceedings were moved from Summit County to Davis County because of Staley's roll in the county.
Davis County attorney Troy Rawlings says, "This type of behavior is criminal. It's serious and we're handling it accordingly. Mr. Staley is presumed innocent."
Staley will likely appear in court later this month. If this case goes to a jury trial it will likely begin in July of 2013.
