Man acquitted in deputy's murder enter "not guilty" plea to new charges

SALT LAKE CITY (ABC 4 Utah) - Roberto Roman told a federal judge he's "not guilty" of murdering a former MIllard County sheriff deputy.
SALT LAKE CITY (ABC 4 Utah) – The family of Jose Greathouse Fox is hoping the second time around will result in justice.

“We're thankful to the U.S. Attorney's office,” says Cindy Greathouse. (It means) justice for our daughter and son.”

The man accused of killing her daughter, Josie Greathouse Fox made his initial appearance in federal court Monday. Roberto Roman was indicted for murdering Fox and faces other charges related to the crime.

Roman was acquitted of her murder last year in state court. During the trial Roman claimed Ryan was with him in the car and shot his sister.

Monday, Fox’s mother sounded somewhat confident the second time around.

“Yes we are,” says Greathouse. “But we were last time too though.”

Fox's family was outraged when Roman was acquitted last year. But Greathouse says they’re prepared to go through the painful details once again.

“It's not a good feeling,” she says. “But you do what you have to do.”

Roman's attorney plans to challenge the charges calling it double jeopardy.

“When U.S. Attorney says it's not a do over, it really is a do over,” says defense attorney Steve McCaughey. “That's exactly what they're doing. They don't like the result that happened in Spanish Fork so they're taking another shot at it."

But the federal prosecutor says it’s happened before.

“There have been numerous cases going back a very long period of time where the federal and state government have their own independent investigations and prosecutions," says David Barlow.

That's what Josie Greathouse Fox's family is hoping for, a conviction on the second try.

“We just need justice for our children,” says Greathouse. “That coward got away with it the first time and I hope he doesn't this time.”

The federal judge set a November 21st trial date for Roman.
